Terms and Conditions

1. General Information and Purpose

This document governs the conditions of access and use of the MapaSubastas platform (hereinafter, "the Platform"), accessible at mapasubastas.com and app.mapasubastas.com, owned by MapaSubastas SL (hereinafter, "MapaSubastas").

MapaSubastas is a SaaS (Software as a Service) digital platform that aggregates public information about judicial and administrative auctions from the Boletín Oficial del Estado (BOE - Official State Gazette) and the BOE Auction Portal, and enriches it with proprietary analysis, valuation, artificial intelligence and data visualisation tools.

These terms also apply, where relevant, to the consultancy and training services that MapaSubastas may offer through the Platform or as a complement to it.

3. Acceptance of the Terms

By registering, subscribing to a plan or using the Platform, the user declares that they have read and accepted these Terms and Conditions, as well as the Privacy Policy and the Cookie Notice.

If the user does not agree with any of these terms, they must refrain from using the Platform.

MapaSubastas reserves the right to update these terms at any time (see Section 20 regarding the modification procedure). Users are advised to review this page periodically.

4. Usage and Registration Requirements

4.1. Minimum age

The use of MapaSubastas is restricted to persons aged 18 years or older. If the registration of a minor is detected, the account will be immediately deleted.

4.2. Registration and accuracy of data

To access certain features, the user must create an account by providing truthful, complete and up-to-date information. The user undertakes to keep their data updated at all times.

4.3. Account security

The user is solely responsible for maintaining the confidentiality of their login credentials (email and password). They must immediately notify MapaSubastas of any unauthorised use of their account at [email protected].

MapaSubastas shall not be liable for any consequences arising from the unauthorised use of an account by third parties.

4.4. One account per person

Each user may only maintain one active account. MapaSubastas reserves the right to merge or delete duplicate accounts created by the same person.

4.5. Consumer and professional users

The Platform may be used by both consumers (natural persons acting for purposes outside their professional activity) and professional users. Consumer protection provisions under Spanish and European legislation apply exclusively to users who qualify as consumers pursuant to Royal Legislative Decree 1/2007 (LGDCU).

5. Description of the Service

5.1. The Platform

MapaSubastas provides a tool for searching, viewing and analysing judicial and administrative auctions published in the BOE. The Platform aggregates public data and enriches it with proprietary features such as estimated market valuations, AI-generated reports, comparable property analysis, profitability calculators, personalised alerts and cadastral maps, among others.

5.2. Subscription plans

MapaSubastas offers several access tiers: a free plan with basic features and paid plans with advanced features. The current features and prices for each plan are detailed on the pricing page. Subscribing to a plan grants access to the features described at the time of subscription.

5.3. Consultancy services

In addition to the Platform, MapaSubastas offers complementary professional services (auction consultancy, investor advisory, mentoring), the specific terms of which are formalised through an individual agreement for each service.

5.4. Availability

MapaSubastas strives to keep the Platform continuously available, but does not guarantee a specific level of availability (SLA). Interruptions may occur due to maintenance, updates or circumstances beyond the control of MapaSubastas.

6. Data Sources and Limitation of Liability Regarding Information

6.1. BOE data (public information)

The base information about auctions comes from the Boletín Oficial del Estado (BOE) and the BOE Auction Portal (subastas.boe.es), which are publicly accessible sources. MapaSubastas does not generate this data and does not guarantee its accuracy, completeness or currency, as it depends on the information published by the competent authorities.

The legal reports generated by the Platform are prepared from the official documentation available in the auction file, including — where available — the edict and the certificate of encumbrances published on the BOE portal. Where such documentation is not available, the user may upload their own documentation (property register note or certificate of encumbrances) for the system to analyse.

6.2. Enriched data (proprietary information)

Market valuations, legal and property risk reports (generated entirely by artificial intelligence), comparable analyses, profitability calculations, charge analyses and other analytical tools are proprietary developments of MapaSubastas. This data is generated through automated processes and artificial intelligence models, and constitutes indicative estimates, not official appraisals, expert opinions or certified professional valuations.

In particular, the legal reports available on the Platform are generated by an artificial intelligence system without the involvement of lawyers or legal professionals. They do not constitute professional legal opinions and may contain errors of interpretation.

6.3. Does not constitute advice

No content, data, report or analysis provided through the Platform — including AI-generated legal reports — constitutes legal, financial, tax or investment advice. The information is provided for informational and guidance purposes only. The user should consult qualified professionals before making investment decisions based on the information provided by the Platform.

6.4. Third-party data

The Platform integrates data and information from third parties (Cadastre, Google Maps, property portals, among others) which are subject to their own terms of use and accuracy limitations. MapaSubastas is not responsible for the accuracy of such third-party data.

7. Subscription Plans and Contracting

7.1. Plan types

MapaSubastas offers four service tiers: Free, Personal, Pro and Premium. The features included in each plan are described on the current pricing page.

7.2. Billing cycles

Paid plans may be contracted with monthly or annual billing, as selected by the user. Annual plans are billed as a single payment at the start of the period.

7.3. Automatic renewal

Subscriptions renew automatically at the end of each billing cycle (monthly or annual), unless the user cancels before the renewal date. Upon renewal, the price in effect at that time will apply (see Section 8).

7.4. Plan changes

The user may change their plan at any time. Plan upgrades take effect immediately with prorated billing. Plan downgrades take effect at the end of the current billing cycle.

7.5. Offers and promotions

MapaSubastas may offer free trial periods or promotional pricing at its discretion. The terms of each offer will be communicated at the time of publication.

8. Pricing and Price Modifications

8.1. Current prices

The prices for each plan are displayed on the pricing page and include VAT applicable to consumer users resident in Spain. All prices are expressed in euros (€).

8.2. Price modifications

MapaSubastas reserves the right to modify the prices of its plans at any time. Price changes are governed by the following rules:

• Annual subscriptions: the price in effect at the time of subscription or the last renewal is maintained for the entire contracted annual period. The new price, if any, will apply at the next renewal.
• Monthly subscriptions: price changes will apply from the next monthly billing cycle, never during the current month.

In no event will a price change affect the billing cycle already in effect for the user.

8.3. Notification of changes

MapaSubastas will make reasonable efforts to inform users of price changes by email or in-Platform notification prior to their next renewal date. If the user does not agree with the new price, they may cancel their subscription before the renewal takes place.

8.4. Payment method

Payments are processed via credit or debit card through the Stripe payment gateway, which complies with the PCI-DSS standard. MapaSubastas does not store or have direct access to the full card details of the user.

8.5. Non-payment

In the event that a charge is declined, MapaSubastas may retry the charge or temporarily suspend access to paid features until the payment issue is resolved.

9. Right of Withdrawal

9.1. Withdrawal period

In accordance with Articles 102 to 108 of Royal Legislative Decree 1/2007 (LGDCU), users who qualify as consumers have a period of 14 calendar days from the date of subscribing to a paid plan to exercise their right of withdrawal without the need to provide any justification.

9.2. How to exercise the right of withdrawal

To exercise this right, the user must send a clear and unequivocal communication to [email protected] stating:

• Subject: "Withdrawal"
• Full name and account email
• Date of plan subscription
• A declaration that they are withdrawing from the contract

9.3. Refund

Once the withdrawal request is received, MapaSubastas will process a full refund within a maximum period of 14 calendar days, using the same payment method used by the user.

9.4. Exception for immediate commencement of the digital service

In accordance with Article 103(m) of the LGDCU, if the user has given their express consent for the digital service to commence immediately during the withdrawal period and has acknowledged that they thereby lose their right of withdrawal, they may not exercise such right once they have accessed the premium features of the Platform.

This consent is obtained clearly during the subscription process.

9.5. Consultancy services

For consultancy services, the right of withdrawal applies from the date of contracting, unless the service has been fully performed with the prior consent of the user.

10. Cancellation of Subscriptions

10.1. Cancellation by the user

The user may cancel their subscription at any time from their account settings on the Platform or by sending an email to [email protected].

10.2. Effect of cancellation

The cancellation takes effect at the end of the current billing cycle. Until that date, the user retains access to all features of their plan. Once the cycle ends, the account reverts to the Free plan.

10.3. No partial refunds

Outside the withdrawal period established in Section 9, no refunds will be issued for the remaining time of a billing cycle following cancellation.

10.4. Data retention

After cancellation, user data (favourites, notes, alerts) is retained for 12 months. If the user reactivates a paid plan within that period, their data will be restored. After 12 months, data may be deleted.

10.5. Cancellation by MapaSubastas

MapaSubastas may cancel a subscription and offer a prorated refund in the event of service discontinuation or force majeure.

11. Consultancy Services

11.1. Scope

MapaSubastas offers complementary professional services, such as auction consultancy, investor advisory and mentoring programmes. These services are formalised through an individual agreement detailing the scope, price, deliverables and specific terms of each service.

11.2. Informational nature

Consultancy services are of an informational and educational nature. They do not constitute professional legal, financial, tax or investment advice. MapaSubastas consultants do not act as regulated financial advisors.

11.3. Liability

MapaSubastas' liability in relation to consultancy services is limited, in all cases, to the amount actually paid by the user for that specific service.

12. Platform Usage Rules

12.1. Permitted use

The Platform is intended for personal or professional use for informational purposes related to real estate and judicial auctions in Spain. The user undertakes to use the Platform in good faith and in compliance with applicable law.

12.2. Prohibited conduct

The following is expressly prohibited:

• Scraping and automated extraction: using bots, scrapers, crawlers or any automated tool to extract data from the Platform on a mass scale.
• Data redistribution: copying, redistributing, reselling, sublicensing or making available to third parties the data, reports, valuations or any content generated by the Platform, whether free of charge or commercially.
• Sharing credentials: providing third parties with access to the user's account or sharing login credentials.
• Circumventing limits: creating multiple accounts to multiply usage limits (AI reports, alerts, downloads, etc.) or to circumvent plan restrictions.
• Reverse engineering: attempting to decompile, disassemble, reverse-engineer or access the source code of the Platform, its algorithms or AI models.
• Interference with the Platform: taking actions that compromise the security, stability or performance of the Platform or that affect other users' access.
• Illegal use: using the Platform for any activity contrary to applicable law, including money laundering, fraud or criminal activities.
• Spam and unsolicited communications: using the Platform to send mass communications, spam, phishing or malware.
• Identity impersonation: impersonating another person or misrepresenting one's relationship with any entity.

12.3. Fair use

Each plan has specific usage limits (number of AI reports, alerts, downloads, etc.) which are detailed on the pricing page. MapaSubastas may apply temporary usage restrictions if it detects abusive consumption patterns that significantly exceed the normal expected use for the contracted plan.

13. Suspension and Termination of Accounts

13.1. Temporary suspension

MapaSubastas may temporarily suspend access to an account in the following cases:

• Reasonable suspicion of a breach of these terms (during investigation).
• Non-payment after reasonable collection attempts.
• Security concerns (potentially compromised account).

13.2. Permanent termination (ban)

MapaSubastas may permanently terminate an account in the following circumstances:

• Confirmed breach of the prohibited conduct set out in Section 12.
• Repeated conduct that has led to previous suspensions.
• Fraud, illegal activity or use of the Platform for criminal purposes.

13.3. Procedure

Except in cases of fraud, illegal activity or security emergencies, MapaSubastas will notify the user by email before proceeding with permanent termination, granting them a period of 7 days to submit their representations.

13.4. Financial consequences

• Termination due to the user's fault: no refund will be issued.
• Termination without cause by MapaSubastas: a prorated refund of the unused subscription period will be issued.

13.5. Data following termination

Following account termination, personal data will be processed in accordance with the Privacy Policy. User-generated data (favourites, notes, alerts) will be deleted within 30 days.

13.6. Right of appeal

A user whose account has been terminated may submit a complaint by sending an email to [email protected] within 15 days of the notification. MapaSubastas will review the request and communicate its decision.

14. Intellectual and Industrial Property

14.1. MapaSubastas ownership

The Platform as a whole — including its design, source code, algorithms, artificial intelligence models, analysis methodologies, reports, brand, logo and all original content — is the property of MapaSubastas SL and is protected by the Intellectual Property Law (Royal Legislative Decree 1/1996) and other applicable legislation.

14.2. BOE data and protected database

The raw auction data from the BOE is in the public domain. However, the selection, structuring, presentation, enrichment and analysis of this data by MapaSubastas constitutes a protected database pursuant to Directive 96/9/EC of the European Union on the legal protection of databases and the Spanish legislation transposing it.

14.3. Licence of use

Subscribing to a plan grants the user a limited, non-exclusive, non-transferable and revocable licence to access and use the Platform and its features exclusively for personal or internal professional use. This licence does not include the right to redistribute, sublicense or commercially exploit the content of the Platform.

14.4. User-generated content

The user retains ownership of the data and content they create within the Platform (notes, personal comments). By using the Platform, the user grants MapaSubastas a licence to process such data to the extent necessary to provide the service.

14.5. Trademarks

"MapaSubastas", "TOPsubastas" and their associated logos are registered trademarks (or trademarks pending registration) of MapaSubastas SL. Their use without express written authorisation is prohibited.

15. Limitation of Liability

15.1. Service provided "as is"

The Platform is provided "as is" and "as available", without warranties of any kind beyond those required by law.

15.2. No guarantee of results

MapaSubastas does not guarantee specific results from the use of the Platform or from the information provided through it. Investment decisions are the sole responsibility of the user.

15.3. Quantitative limit

MapaSubastas' total cumulative liability to the user for any claim arising from the use of the Platform shall not exceed, under any circumstances, the total amount paid by the user in the 12 months preceding the claim.

15.4. Exclusion of indirect damages

MapaSubastas shall not be liable for indirect, incidental, special or consequential damages, including — by way of example — loss of profits, investment losses or economic harm arising from decisions made on the basis of the information provided by the Platform.

15.5. Legal exceptions

Nothing in these terms limits the liability of MapaSubastas for damages caused by wilful misconduct or gross negligence, or for any other situation in which Spanish law does not allow the exclusion or limitation of liability.

15.6. Force majeure

MapaSubastas shall not be liable for interruptions or service failures caused by circumstances beyond its reasonable control, including: third-party server outages, failures in external APIs (BOE, Cadastre, Google Maps), natural disasters, government actions, cyberattacks or unavailability of the BOE data source.

16. Personal Data Protection

MapaSubastas processes users' personal data in accordance with Regulation (EU) 2016/679, the General Data Protection Regulation (GDPR), and Organic Law 3/2018 on the Protection of Personal Data and guarantee of digital rights (LOPDGDD).

For detailed information on what data is collected, for what purpose, for how long and what rights the user has, please refer to our Privacy Policy.

Third parties that may access user data as data processors include: Stripe (payment processing), Google (Analytics and Maps) and Amazon Web Services (infrastructure).

The user has the right to lodge a complaint with the Spanish Data Protection Agency (AEPD) at www.aepd.es.

17. Cookies

MapaSubastas uses its own and third-party cookies to ensure the operation of the Platform, analyse traffic and personalise the user experience. For more information about the types of cookies used and how to manage them, please refer to our Cookie Notice.

18. Electronic Communications

18.1. Service notifications

By registering, the user agrees to receive electronic communications related to the service: payment confirmations, account notifications, security alerts and notices about changes to the terms or prices. These communications are necessary for the provision of the service and do not require additional consent.

18.2. Commercial communications

The sending of commercial or promotional communications requires the user's prior express consent, in accordance with Article 21 of Law 34/2002 (LSSI-CE). The user may withdraw this consent at any time via the unsubscribe link included in each communication or by contacting [email protected].

19. Dispute Resolution

19.1. Amicable resolution

In the event of any dispute, the parties shall endeavour to reach an amicable solution. The user may contact MapaSubastas at [email protected].

19.2. Online Dispute Resolution (ODR) platform

In accordance with Regulation (EU) 524/2013, we inform consumer users of the existence of the European online dispute resolution platform, accessible at: https://ec.europa.eu/consumers/odr/

19.3. Consumer arbitration

Consumer users may submit their claims to the Consumer Arbitration System, in accordance with applicable Spanish legislation.

19.4. Jurisdiction

For disputes that are not resolved through the above channels:

• Consumer users: the Courts of the consumer's domicile shall have jurisdiction, in accordance with Article 90.2 of the LGDCU.
• Professional users: the parties submit to the Courts of Seville, Spain, expressly waiving any other jurisdiction that may correspond to them.

20. Modification of the Terms

MapaSubastas reserves the right to modify these Terms and Conditions at any time.

Material changes will be notified to users with a minimum of 15 days' advance notice before they take effect, by email or prominent notice on the Platform.

Continued use of the Platform after the effective date of the new terms shall be deemed acceptance thereof. If the user does not agree with the changes, they may cancel their subscription before that date.

The "last updated" date at the end of this document reflects the current version.

21. General Provisions

21.1. Severability

If any provision of these terms is declared void or unenforceable, the remaining provisions shall remain in full force and effect.

21.2. No waiver

The failure of MapaSubastas to exercise or delay in exercising any right under these terms shall not constitute a waiver thereof.

21.3. Entire agreement

These Terms and Conditions, together with the Privacy Policy and the Cookie Notice, constitute the entire agreement between the user and MapaSubastas in relation to the use of the Platform.

21.4. Assignment

MapaSubastas may assign its rights and obligations under these terms to third parties (for example, in the event of an acquisition or business merger), notifying the user. The user may not assign their account or their rights without prior authorisation.

21.5. Applicable law

These terms are governed by Spanish law.

21.6. Language

In the event of any discrepancy between translated versions of these terms, the Spanish version shall prevail.
